U.S. Asbestos Bankruptcy Trust Funds: Seeking Compensation for Asbestos Victims

The U.S. Asbestos Bankruptcy Trust Funds have played a crucial role in compensating asbestos victims. They have disbursed nearly $21 billion to over 600,000 asbestos claimants, providing financial relief to those affected by asbestos-related diseases. Currently, approximately 60 active Asbestos Trust Funds remain, holding an estimated $32 billion in remaining assets.

These Asbestos Settlement Trusts were established with the primary aim of compensating workers and their families who have suffered due to asbestos exposure, leading to diseases like Mesothelioma. When an asbestos company establishes a Trust Fund, the compensation amounts for Mesothelioma claimants are determined by trustees overseeing the fund. This legal mechanism allows asbestos defendants to file for protection under bankruptcy reorganization, enabling them to address claims while continuing their operations.

It’s important to note that settlements from Asbestos Trust Funds typically do not entail an admission of guilt by the asbestos company responsible for the fund. This legal process seeks to provide fair compensation to victims without necessarily implicating liability.

History of Asbestos Use

A.P. Green Industries was founded in the year 1910 as a plant responsible for making brick and clay.  The company flourished and was eventually acquired by the U.S. Gypsum Company in 1967.  They were known for using asbestos products in the past and worked with A.P. Green Industries until 1988 when Global Technologies Industries came into the picture.  This helped the company become a key player in refractory products.

Refractory products use materials that are incredibly heat resistant and withstand high amounts of pressure and chemicals.  Companies often add asbestos to products such as cements and roofing to achieve resistance.  Asbestos is a group of minerals that contain fibers that stop heat, and companies are allowed to use the product as long as it doesn’t account for more than 1% of the product.  A.P. Green Industries products were using asbestos in their products above the legal limit amount.  Out of their 1,200 products, 22 of them were found to be containing asbestos, and the percentage of the toxic material in their products ranged from 3% all of the way up to 18%.

Employees working for A.P. Green Industries were exposed to environments full of airborne asbestos fires.  Those most exposed include: factory workers, utilities men, factory workers, and steamfitters.  When exposed to large amounts of the materials as they were, it can cause diseases such as mesothelioma or asbestosis as well as cancers which have serious long-term effects.

Eventually, in 1976 A.P. Green finally discontinued their product line of Green PC.  Finally, in 2002 the company filed for bankruptcy due to the cumulating number of asbestos lawsuits.

Asbestos Litigation

During the time span from 1995 to 2007 A.P. Green Industries’ workers had filed almost 400,00 lawsuits against the company and two of its partners Harbison-Walker Refractories, and Global Industrial Technologies Incorporated.  In 2002 A.P Green Industries filed for bankruptcy due to a growing number of asbestos lawsuit claims.  They had multiple pending lawsuits and were expected to pay $490 million for health damages they had inflicted on past employees.  Together A.P. Green and its affiliates decided to create the Asbestos Trust Fund for victims to receive compensation after having a consistently growing number of related lawsuits.  All three companies had created success by relying on asbestos products in the past, and repercussions were starting to take effect. The trust was created in 2013 containing $333 million dollars in funding, and after a year of waiting was accepted to start handling claims in 2014. The current payout percentage for the A.P. Green Trust is 4.5%, but claimants may receive higher award values based on a variety of factors.  A.P. Greene has had to settle thousands of claims by paying millions of dollars for the harm they have caused.

Occupational Exposure

Due to the fact that products containing asbestos were highly prevalent in A.P. Greens Industries many individuals including workers and the general public were put at risk.  Since the company expanded quite quickly, there were multiple plants in which individuals may have come into contact with asbestos materials.  Some workers were exposed on a routine schedule, and due to affects have asbestos related health complications.  Various occupations that may have been affected include plant workers, veterans, steamfitters, pipe fitters, boiler tenders/makers, industrial workers, and steel mill workers, and shipyard workers.

How Do Mesothelioma Trust Funds Work?

Asbestos exposure victims diagnosed with mesothelioma and other asbestos-related diseases can submit their claims to asbestos settlement trusts belonging to the bankrupt asbestos companies responsible for their illness.  Surviving relatives of mesothelioma that have died from asbestos exposure are also eligible to submit claims to responsible asbestos trust funds.

After submitting a claim, asbestos trust funds decide whether to pay a claim. The decision to pay a claim is made separate from the company that created the trust fund.

Family Member Died from Mesothelioma?

If a family member has tragically passed away from mesothelioma, pursuing legal action is still possible. It’s essential to act swiftly as there are statutes of limitations in place. Begin by consulting an experienced mesothelioma attorney who specializes in wrongful death cases. They can guide you through the process, investigating the asbestos exposure that led to your loved one’s illness and death. By filing a wrongful death lawsuit, you can seek justice and compensation for the pain, suffering, and financial hardships caused by their passing. While it can’t bring your loved one back, it can provide support for your family’s future.

Understanding the Mesothelioma Statute of Limitations

The mesothelioma statute of limitations is a critical factor for those seeking legal action after a diagnosis. This law sets a timeframe within which a lawsuit must be filed. Typically, it begins from the date of diagnosis or the date of death, depending on the circumstances. Due to the long latency period of mesothelioma, which can range from 10 to 50 years, victims may not realize their exposure until later in life. To ensure your eligibility for compensation, it’s crucial to consult an experienced mesothelioma attorney promptly. They can guide you through the legal process, helping you secure the compensation you deserve.

Mesothelioma Latency Period

Mesothelioma, a deadly cancer caused by asbestos exposure, has a lengthy latency period, typically spanning 10 to 50 years. This extended delay between exposure and diagnosis often catches individuals by surprise. Many veterans, shipyard workers, construction workers, and others in high-risk occupations may be living with the early stages of asbestos-related diseases without realizing it. While some mesothelioma lawyers may not handle cases related to asbestosis, asbestos lung cancer, pleural plaques, pleural thickening, colon cancer, or esophageal cancer, there are dedicated legal experts who specialize in assisting asbestos victims with their legal claims and pursuing the compensation they deserve.
