Asbestos Litigation

Former employees such as automotive workers have been naming Chrysler in lawsuits due to their use of asbestos in products from 1925 through the 1970s.  They have been named in a variety of cases, and evidence has been presented proving that Chrysler knew asbestos was dangerous but chose not to use warning labels.

In one case, a seventy-three-year-old named Alfred D’Ulisse sued the company in 2006 after developing mesothelioma.  He had been exposed to asbestos from Chrysler’s brakes.  A New York jury awarded him $25 million in compensation.

History of Asbestos Use

Daimler Chrysler, originally known as Chrysler Corporation, was founded in Detroit, Michigan, in June of 1925.  The company was founded by Walter Chrysler and manufactured various car parts, and over time, became a prominent innovator of car models and parts.

The products Chrysler Corporation manufactured needed to be able to withstand high amounts of pressure, heat, and chemicals.  Companies often add asbestos to their products, such as brakes, because it is inexpensive and durable.  Chrysler Corporation started utilizing asbestos in their products early on in their company’s history in 1925.  Asbestos is a group of minerals that contain fibers that stop heat, and companies are allowed to use the material as long as it doesn’t account for more than 1% of the product.  Chrysler Corporation was using asbestos in their products above the legal limit.

Employees working for the company were exposed to environments full of airborne asbestos fibers.  When exposed to large amounts of the materials, it can cause diseases such as mesothelioma, asbestosis, and cancers with serious long-term effects.  Chrysler began asbestos-related lawsuits beginning in the 1980s.

In 1988, Chrysler Corporation’s name officially switched to Daimler Chrysler Motors Company after joining a partnership with Daimler-Benz from Germany.  After Daimler suffered financial struggles for almost a decade, they decided to sell their shares to Chrysler.  In 2007, Daimler sold their shares for $7.4 billion to them.  The company’s name then changed to Chrysler Holding LLC and was divided into two subsidiaries.  The first subsidiary was called Chrysler Motors LLC, and the second was Chrysler Financial Services LLC.

Chrysler couldn’t recover financially, and in 2019, they filed for bankruptcy.  The United States Government offered to provide the company with $6 billion if they agreed to partner with Fiat to become Fiat Chrysler Automobiles.  The company agreed, and now their brands include Chrysler, Maserati, Alfa Romeo, Ram, Jeep, and many other big names.

Chrysler continues to receive lawsuits to this day and has had to deal with a high number of claims due to their automobile parts that contained asbestos.  There have been thousands of individuals who have sued the company for compensation.



Asbestos Trust Fund

After receiving thousands of lawsuits and struggling with financial instability, Chrysler filed for bankruptcy in 2009.  They began working on a reorganization plan that included starting a trust to cover health care costs for their retired employees.

In 2010, a trust was started called the UAW Retiree Medical Benefits Trust.  This trust covered 860,000 members but did not cover the workers who were exposed while using Chrysler’s asbestos products.

When the company was in the process of bankruptcy, they tried to move active asbestos lawsuits to bankruptcy court.  They did this because they hoped their scientific logic would be enough to get them a nationwide dismissal of the claims, but a federal judge denied them.  They remanded all asbestos claims filed against the company back to every individual state they were filed in.

A Second Circuit Court of Appeals allowed the sale of “Old Chrysler’s” clear of any existing legal liability as well as assets free.  This included “New Chrysler” liabilities too. They declined to define whether the bankruptcy court had the authority to bar future claims.
