Asbestos Trust Fund
After United States Gypsum filed for chapter 11 bankruptcy protection in July of 2001, they created a reorganization plan. The company reemerged from bankruptcy in 2006 with a Joint Plan of Reorganization and an asbestos trust fund to handle current and future claims.
Currently, the trust fund has a payment percentage of 19.5%. Every case is evaluated on various factors, including age, illness, and exposure. The United States Gypsum trust also handles asbestos-related injury claims against A.P. Green Industries, which they acquired in 1967.

United States Gypsum Company was established in 1902 through a merger of thirty-seven calcining and mining plants. Thirty of the companies involved in the merge were different plaster and gypsum rock manufacturing companies. After the company was established, its goal was to produce plaster products.
The company was successful and able to branch out into other fields, including construction products. Many of the products United States Gypsum Company was producing needed to withstand incredibly high levels of heat, and a mineral that could achieve that was asbestos. Not only was asbestos durable, but it was also inexpensive. The company added it into its products at the beginning of the 1920s. Asbestos is a group of minerals that contain fibers that stop heat, and companies are allowed to use the mineral as long as it doesn’t account for more than 1% of the product. United States Gypsum Company’s products used asbestos above the legal limit. Employees working for them were exposed to environments full of airborne asbestos fibers. At the beginning of the 1930s, the company employed a laboratory to research the results of asbestos exposure in dust form. After the research was done, it was clearly evident that asbestos was incredibly harmful to humans, causing cancer and other diseases. The company chose not to disclose the information to employees and instead used marketing strategies to advertise the product’s safety and usability.
The company only continued to flourish after that. During World War I and the Great Depression, they expanded their product lines even further and became known for their construction materials. When the war finally ended, the housing industry skyrocketed, and new housing was in demand. United States Gypsum company was a lead supplier of asbestos materials during this time, and they even started working in the commercial industry.
United States Gypsum continued to use asbestos for around fifty years; they finally stopped using the material in the 1970s. After the 1970s, they began receiving thousands of asbestos-related lawsuits, which eventually forced them to file for bankruptcy protection in 2001. The company is still currently operating and now has been for over a century.
