Asbestos Trust Fund

In 2002, the Armstrong World Industries created a trust fund consisting of two-thirds of their company shares, in order to cope with all of their asbestos related lawsuits.   The funds were available to them due to the bankruptcy in 2000.  In 2007, they officially started accepting claims with a trust funded by over $2 billion.  Your settlement is based off of factors including the amount of exposure, age, and type etc.  In 2020, the payment percentage was 19.7 which had decreased from past years.  Currently Armstrong World Industries still has over 3,000 employees and over 25 manufacturing plants.


Asbestos Litigation

The ramifications from the exposure and use of asbestos did not begin to come to light until the middle of the 1980’s.  It was found that the company understood that the material was harmful starting in the 1930’s, but high up company executives did not feel it was their responsibility to warn their employees.

There were two main cases that set the precedent for asbestos litigation.  The first occurred in 1991 when Raymond Miller who was an insulator was diagnosed with pleural thickening before being officially diagnosed with asbestos poisoning.  He won the case and the company was soon covered in lawsuits.  His case set a new precedent in Colorado law that filing a claim having to do with a second asbestos-related disease does not need to occur upon beginning signs of the first disease.

The other case was Borel v. Fibreboard Paper Products Corporation et. al. where courts sided in favor of Clarence Borel.  They claimed that the company failed to give them a warning of risk they were being exposed to.

All of the legal expenses forced Armstrong World Industries to file for bankruptcy in 2000.  More than 150,000 individuals came forward, claiming asbestos-related diseases.  Not only did they have to file for bankruptcy, but they were also put on a list of top polluters in the US.  Their image was so destroyed that they had to rebrand in order to reorganize.


Occupational Exposure

Due to the fact that products containing asbestos were highly prevalent in Armstrong World Industries many individuals including workers and the general public were put at risk.  30 years after the industries were started over 750 individuals were employed, and from there they only expanded.  In 2016 they had 3,000 employees and the company was known for their concern for employees.  High risk employees include: plant workers, insulation installers, acoustical workers, construction workers, factory workers, machine operators, floor tile layers, research employees, production employees, and mechanical engineers.  Every single worker they employed from the 1900’s to 1980’s may have been exposed to harmful asbestos from working near or with products.  Not only were the workers effected, but the products manufactured were installed in homes around the country as well as utilized during World War II.


History of Asbestos Use

Armstrong World Industries originated in Pittsburgh, Pennsylvania, and was founded in1860 by John D. Glass and Thomas M. Armstrong.  The company flourished quickly and by the 1890’s Armstrong World Industries was incorporated and considered one of the largest cork manufacturers in the world.

After conquering the cork industry, they began to expand and produce other products including insulation, flooring, and ceiling materials.  Coincidently at the same time they began to expand, the use of asbestos became popular due to how inexpensive it was.  One of their most popular products that used the toxic materials was vinyl asbestos tile which could be found in homes across the USA.  Asbestos is a group of minerals that contain fibers that stop heat, and companies are allowed to use the product as long as it doesn’t account for more than 1% of the product.  Armstrong World Industries had products with an incredibly high amount of the toxic material.  For example, their vinyl and linoleum flooring contained up to 70% asbestos, and their limpet spray insulation contained 100% asbestos.  Employees working for Armstrong and World Industries as well as the general public were exposed to these harmful materials.  People with exposure were put at risk for diseases such as mesothelioma or asbestosis as well as cancers which have serious long-term effects.

Armstrong World Industries continued thriving through difficult circumstances including the death of Thomas Armstrong, the Great Depression, and World War II.  The company’s business continued to surge, and they were able to build factories in California, Illinois, and Mississippi.  Armstrong World Industries was able to capitalize on the war by producing plane parts, submarine parts, ammunition, and even camouflage.  Asbestos was a material highly utilized in the war by many industries.

The industry did not stop working with asbestos until 1987, and by this point Armstrong World Industries consisted of multiple companies and entities.  By 2000 over 175,000 claims had been made against the company for harmful effects and injuries from asbestos.  It was estimated that their potential liability would be over $1.3 billion.  Finally, in 2000, the company filed for bankruptcy and six years later they reorganized.  When they reorganized, they set up an asbestos trust fund and in 2007 began receiving claims.
