Asbestos Trust Fund

After E.J. Bartells filed for Chapter 11 bankruptcy in 2000, they made a plan to reorganize.  As part of their reorganization plan, they created the E.J Bartells Trust Fund to handle current and future claims.

The newly reorganized E.J. Bartells has not been entangled with any asbestos lawsuits.


Asbestos Litigation

The company’s asbestos history eventually caught up to them, and they began accumulating asbestos-related lawsuits mainly from previous employees.  After receiving thousands of claims, the company was forced to file for Chapter 11 bankruptcy in 2000.  Well-known cases they encountered included one in which a former machinist and electrician passed away from pleural mesothelioma after working for E.J. Bartells Corporation.  His wife sued E.J. Bartells as well as a dozen other companies for being liable.  In the end, the family was awarded $3 million for a combination of compensatory damages, non-economic damages, and punitive damages.

Since products containing asbestos were highly prevalent in E.J. History of Asbestos Use

E.J. Bartells Company was originally established in 1923 by Edwin J. Bartells.  The company manufactured various products for the refractory industry, including tapes, insulation, and adhesives.

The products E.J. Bartells was manufacturing needed to withstand high amounts of heat, pressure, and chemicals.  Companies often add asbestos to products such as insulation and cement to achieve heat resistance.  Asbestos is a group of inexpensive minerals that contain fibers that stop heat, and companies are allowed to use the product as long as it doesn’t account for more than 1% of the product.  E.J. Bartells Company products used asbestos above the legal limit.

E.J. Bartells first began adding asbestos to their products early in its history and continued

using it until the late 1970s.  Employees working for them were exposed to environments full of airborne asbestos fibers.  When exposed to large amounts of the materials, it can cause diseases, such as mesothelioma, asbestosis, and cancers with serious long-term effects.

E.J. Bartells Company was quite successful and worked with multiple big-name companies, including many asbestos product manufacturers.  A few of the companies they worked with included Apollo Sheet Metal, Intel, and Xerox.

The asbestos damage they caused eventually caught up to them, and they began receiving lawsuits mainly from previous employees and users.  In 2000, the company filed for Chapter 11 bankruptcy protection.

The company was eventually considered inactive.  In 2001, a private company decided to rehabilitate the company as E.J. Bartells.
