Asbestos Trust
After Republic Power Metals filed for bankruptcy in 2014, they decided to start a trust. The company added over seven hundred million to fund a Bondex asbestos trust which started operating in 2016. The company made it so that individuals had until January 1,2020 to file a claim. An individual with an illness related to asbestos has a total of three years from diagnosis to make a claim. Currently the payment percentage is 22%.
Asbestos Litigation
During the 1980’s, the company started receiving lawsuit issues due to their use of asbestos in their products. In the first year of lawsuits, they only paid a little over a million dollars, but the cases only grew and by 2000 they were paying over eight million. Republic Powered Metals’ insurance was having to pay over $60 million dollars each year to cover costs. Eventually they were not able to use insurance help which forced Bondex’s holding company, Specialty Products Holding Incorporation to close in 2010. They were able to file for Chapter 11 Bankruptcy, and the year they went bankrupt they received over ten thousand lawsuits related to asbestos issues. Most of these lawsuits were coming from Southern areas of the United States. The company paid over five hundred million during the span of 1980-2010. Then in 2014, Republic Powered Metals filed for Bankruptcy as well.
History of Asbestos Use
Originally, Bondex International was founded in St. Louis, Missouri in 1959, and was considered a small brand that sold different construction materials. The business quickly profited and caught the eye of bigger brands. One brand that took notice of them was Republic Powered Metals, and in 1955 they made the decision to purchase Bondex’s parent company, Reardon. This gave the company an entry way into products with consumer focus.
Republic Powered Metals went on to continue expanding, buying more and more small companies. A lot of the smaller companies they were buying used asbestos in their products, including Bondex and a company called DAP Products Incorporated. Asbestos products use materials that are incredibly heat resistant and withstand high amounts of pressure and chemicals. Companies often add asbestos to products such as cements and roofing to achieve heat resistance. Asbestos is a group of minerals that contain fibers that stop heat, and companies are allowed to use the product as long as it doesn’t account for more than 1% of the product. Bondex’s products were using asbestos in their products above the legal limit amount. When exposed to large amounts of the materials as they were, it can cause diseases such as mesothelioma or asbestosis as well as cancers which have serious long-term effects.
They continued using the toxic materials until 1977. They stopped because the U.S. Consumer Product Safety Commission banned asbestos, meaning Bondex’s brand. Julius Nemeth fought the deadline and argued for an extension based on the fact that the product had been used for a long time, and it would hurt their finances.
Bondex over the next couple of years began to accumulate thousands of lawsuits until they were forced to file for Chapter 11 bankruptcy protection in 2010. They regrouped and reorganized in 2016 by creating the Bondex Asbestos Personal Injury Trust. The trust consisted of $450 million when it began accepting claims.
