After Asea Brown Boveri were forced to file for Chapter 11 bankruptcy in February of 2003, they reorganized and created a trust plan. Over two years passed before they created a fund, and then finally in 2006 they approved the Combustion Engineering Asbestos PI Trust with over $1.4 billion dollars. In the year 1912, two large industrial companies, Grieve Gate Company and American Stocker Company merged together to create what would become known as Combustion Engineering. Combustion Engineering originally started off by selling fuel burning products, such as coal stokers. Many of the products they were creating including boilers, needed to have high heat resistance, and a material that would give them that was asbestos. Asbestos is a group of minerals that contain fibers that stop heat, and companies are allowed to use the product as long as it doesn’t account for more than 1% of the product. Combustion Engineering products were using asbestos in their products above the legal limit amount. When exposed to large amounts of the materials as they were, it can cause diseases such as mesothelioma or asbestosis as well as cancers which have serious long-term effects.
The company only continued to expand and as they did, they manufactured more products with asbestos. They started manufacturing building materials such as cement, and during World War II built boilers for ships. In the 1990, the company was taken over by Asea Brown Boveri, a big electrical company. When they took over Combustion Engineering had stopped using asbestos, but they would still have consequences for the damage they caused from using it previously.
All of the liability for asbestos-related claims fell onto the shoulders of Asea Brown Boveri, and they couldn’t handle the financial debt. They had to file for Chapter 11 Bankruptcy in 2003, and in 2006 they created an asbestos trust fund.
