Asbestos Trust Fund

After Federal-Mogul took on liability for T&N and Flexitallic claims, they quickly realized they couldn’t handle the financial demands.  In October of 2001, the company filed for Chapter 11 bankruptcy and began a reorganization plan.  Seven years later, in 2007, Federal-Mogul reemerged from bankruptcy and created a trust consisting of four sub-funds to handle claims from the different asbestos companies they acquired.

They established the T&N sub-fund to handle all current and future Flexitallic asbestos-related claims.  The fund consisted of $635 million and began officially accepting claims in August of 2010.

Currently, the payment percentage for successful claims is 8.5%.  Each case is evaluated on various factors, including age, illness, and exposure.


Asbestos Litigation

Out of the 350,000 claims Federal-Mogul was responsible for, 158,000 of them were for Flexitallic.  Most of the lawsuits came from previous Flexitallic employees who worked with their gaskets, and well-known cases include:

2001-  A United States Navy veteran claimed he developed mesothelioma after working with Flexitallic’s products while onboard a Navy destroyer vessel.  He was responsible for working directly with the gaskets.  A jury in California awarded the veteran $4.2 million.

2001- Flexitallic lost a case and had to pay $35.2 million to victims in compensation after twenty-two refinery workers developed asbestosis after working at their location in Texas.


History of Asbestos Use

Flexitallic was initially founded in the mid-19th century in England and was responsible for making sheet materials.  It wasn’t until 1912 that the company formed its U.S. division in Camden, New Jersey.

They created the industrial spiral wound gasket in the first year of operation and were the sole manufacturers of it until the 1940s.  The company flourished and created a variety of gaskets and seals for different industries.  Their most popular product continued to the spiral wound gasket, which they produced using asbestos.

Companies often add asbestos to products such as cement and roofing to achieve heat resistance.  Asbestos is a group of minerals that contain fibers that stop heat, and companies are allowed to use the product as long as it doesn’t account for more than 1% of the product.  Flexitallic products were using asbestos in their products above the legal limit.  The asbestos tape they were using in their gaskets contained 90% asbestos.  Employees working for them were exposed to environments full of airborne asbestos fibers.  When exposed to large amounts of the materials as they were, it can cause diseases such as mesothelioma or asbestosis and cancers that have serious long-term effects.

The company became more well-known and popular due to the popularity of its products during World War II.  United States Navy battleships used Flexitallic’s specialized gaskets to conceal steam loss.

In 1970, the company was purchased by an asbestos conglomerate called T&N PLC, formerly known as Turner & Newall Ltd.  After purchasing the company, they decided to move operations to Delaware in 1986.

The new company continued using asbestos in products until 1992.  The company quickly began accumulating asbestos-related lawsuits, and T&N decided to sell its assets to Dan-Loc Bolt and Gasket in 1977.  They still had to pay for asbestos claims and handle the liability.

T&N couldn’t handle the number of accumulating asbestos lawsuits, and Federal-Mogul made a move to purchase the company.  With that decision, they continued to honor the agreement with Dan-Loc Bolt and Gasket by taking on asbestos liability.


Asbestos Products

The Gaskets Flexitallic were manufactured using asbestos tape between the metal rings of the product.  The tape contained 90% asbestos.  The company created a variety of gaskets including:

Style D (used for a self-centering gasket)

Style M Gasket (used for boiler manhole covers)
