After Asea Brown Boveri was forced to file for Chapter 11 bankruptcy in February 2003, they reorganized and created a trust plan. Over two years passed before they began a fund, and then finally, in 2006, they approved the Combustion Engineering Asbestos PI Trust with over $1.4 billion. They also created cash installments for claimants, and they were at an estimated $350 million.
Combustion Engineering received its first claims in the 1960s and by the early 2000s had over 90,000 claims. That number only continued growing and had almost doubled by 2002; they then filed for bankruptcy. Important cases they faced included:
-Jerold Anderson worked as a machinist for thirty-nine years for the Wisconsin Electric Company. He developed mesothelioma from exposure to asbestos while working around boilers. He passed away in 1998, and his wife filed a claim against companies who neglected their responsibilities. The family received $1.05 million from the case.
-Kenneth Wayne Jackson, who worked in Tennessee for a Combustion Engineering plant, died from a disease related to his asbestos exposure. He had worked for the company for thirty-four years, and his widow filed against asbestos manufacturers responsible

In 1912, two large industrial companies, Grieve Gate Company and American Stocker Company merged to create what would become known as Combustion Engineering. Combustion Engineering initially started by selling fuel-burning products, such as coal stokers. Eventually, as they expanded and bought other companies, they started manufacturing for the steam industry. They became a leader in the United States for nuclear steam power supply.
Many of the products they were creating, including boilers, needed to have high heat resistance and a material that would give them that was asbestos. Asbestos is a group of minerals that contain fibers that stop heat, and companies are allowed to use the product as long as it doesn’t account for more than 1% of the product. Combustion Engineering products were using asbestos in their products above the legal limit amount. When exposed to large amounts of the materials as they were, it can cause diseases such as mesothelioma or asbestosis and cancers that have serious long-term effects.
The company only continued to expand, and as they did they manufactured more products with asbestos. They started manufacturing building materials such as cement, and during World War II they built boilers for ships. In 1990, the company was taken over by Asea Brown Boveri, a big electrical company. When they took over, Combustion Engineering had stopped using asbestos, but they would still have consequences for the damage they caused from using it previously.
All of the liability for asbestos-related claims fell onto the shoulders of Asea Brown Boveri, and they couldn’t handle the financial debt. They had to file for Chapter 11 Bankruptcy in 2003, and in 2006 they created an asbestos trust fund.
