Asbestos Trust Fund

After Kaiser Aluminum reorganized from going bankrupt in 2002, they set up the Kaiser Asbestos Personal Injury Trust that consisted of $1.22 billion.  The trust began functioning in 2006, and the current payment percentage for successful claims is 18.1%.  Cases depend on a variety of factors including age, illness, and exposure.

Asbestos Litigation

Kaiser Aluminum first started to deal with lawsuits in the 1980s after having asbestos in its products for almost twenty years.  The lawsuits quickly multiplied, and the company couldn’t handle the financial debt.  They filed for Chapter 11 Bankruptcy in 2002, and at that point, they had over $90 million in asbestos liability.

Many individuals involved in the company in the past exposed the harm asbestos had caused them through lawsuits.  For example, a case occurred in 1996 when a former employee of Kaiser Aluminum named Julius Egan developed mesothelioma.  He worked as a welder, and his exposure to the products in his vicinity caused him large amounts of harm.  He was awarded over $70,000 for his case.

How Do Mesothelioma Trust Funds Work?

History of Asbestos Use

Henry J. Kaiser founded Kaiser Aluminum which worked with product manufacturing in the year 1946.  Kaiser was an incredibly successful businessman and had multiple companies running before he even founded Kaiser Aluminum.  He had been working with steel and manufacturing for WWII when he decided to work with aluminum.  Quickly, Kaiser Aluminum grew, and it became one of the largest aluminum producers in the United States.  The company was doing so well that they were expanding globally.  At the height of their business, they worked in 34 US States, opened a branch in Europe, reached 50 countries, and had over 90,000 employees.

Kaiser Aluminum created products that needed to withstand significant amounts of heat including cement, manufacturing equipment, and insulation.  In 1959, the company added asbestos to achieve that.  Asbestos is a group of minerals that contain fibers that stop heat, and companies are allowed to use the product as long as it doesn’t account for more than 1% of the product.  Kaiser Aluminum products were using asbestos in their products above the legal limit amount.

The company continued manufacturing products with asbestos for nineteen years, from 1959-1978.  They didn’t officially phase out using the toxic material until 1982, and by that point, thousands of individuals including workers and the general public were exposed to the mineral.  When exposed to large amounts of the materials, it can cause diseases such as mesothelioma or asbestosis and cancers with serious long-term effects.

The company began receiving lawsuits from individuals claiming asbestos-related diseases in the 1980’s.  Their lawsuits accumulated until they were forced to file for Chapter 11 Bankruptcy in 2002.  In 2006 the company was able to reorganize and create a trust fund to deal with more claims.  Kaiser Aluminum still currently operates in Canada and the United States with twelve plants.
