After Quigley Company was approved to file for Chapter 11 Bankruptcy in 2013, Pfizer helped create a reorganization plan. They helped fund Quigley’s asbestos-related injury trust fund with $964 million. They also had to pay over $1 billion to settle pending claims. In the summer of 2014, the Quigley Company Inc. Asbestos Trust began accepting claims. The current payment percentage for successful claims ranges from either 3.6% or 14.5%. Payment percentage is determined based on each case’s circumstances. Quigley Company first began receiving lawsuits in 1979. The cases quickly began multiplying into thousands so Pfizer decided to bring Quigley Company back to life and have them file for bankruptcy. Asbestos is a group of minerals that contain fibers that stop heat, and companies are allowed to use the product as long as it doesn’t account for more than 1% of the product. Quigley products were using asbestos in their products above the legal limit amount. They were using the harmful material in multiple locations including in America, Canada, and Europe. Employees working for Quigley Company were exposed to environments full of airborne asbestos fibers.
The company continued to use asbestos from the mid-1930s to the late 1970s. That means that there were around forty years that employees were exposed to the material. In 1968, Pfizer & Co., a big pharmaceutical company, purchased Quigley but ended up selling off its assets to focus on pharmaceutical products.
